These Terms of Service ("Terms") govern your access to and use of Optrek, the mobile and web application provided by Optrek ("we", "us", "our"). By creating an account or using the service, you agree to these Terms.
Optrek is a reference and record-keeping tool for automotive and equipment air conditioning technicians and fleet operators. It provides charge specifications, job logging, a refrigerant gas ledger, licence and compliance record storage, and related reporting features.
Optrek is a tool to help you keep records and reference specifications. It does not replace your professional judgement or your legal obligations. Charge specifications are provided for reference only — always confirm charge weights against the vehicle or equipment data plate and follow OEM requirements. You are responsible for meeting your obligations under the Australian Refrigeration Council (ARC) licence scheme, the Ozone Protection and Synthetic Greenhouse Gas Management Act 1989 (Cth) and related regulations. Optrek does not guarantee that any record will be accepted as compliant by any authority.
You retain ownership of the job records, gas logs, photos and documents you submit ("Your Content"). You grant us a licence to host, store and process Your Content solely to provide the service to you and, where applicable, to your company administrator. If you operate under a company (fleet) account, your licence details and job statistics may be visible to that company’s administrator for workforce compliance, as described in our Privacy Policy.
The service, its design, software and specifications databases (excluding Your Content) are owned by us and protected by Australian and international laws. We grant you a limited, non-exclusive, non-transferable licence to use the service for your internal business purposes while your account is active.
The service uses third-party providers for payment processing (Stripe), artificial intelligence features and email delivery. These providers process data under their own terms. We are not responsible for the acts of third-party providers beyond our control.
The service is provided "as is" and "as available". To the extent permitted by law, we exclude all warranties and conditions not stated in these Terms. Specifications and reference data may contain errors or omissions and should always be verified against authoritative sources.
To the maximum extent permitted by law, our aggregate liability for any claim arising out of or relating to the service is limited to the amount you paid us in the 12 months before the claim, or AUD $100, whichever is greater. We are not liable for indirect, consequential or special damages, or for loss of profit, data or business opportunity.
You agree to indemnify us against losses arising from your breach of these Terms, your misuse of the service, or your infringement of any law or third-party right.
You may close your account at any time from the app. We may suspend or terminate your access if you breach these Terms, if your account is inactive, or to comply with legal obligations. Upon termination, your right to use the service ends; we will retain records as required by law and our retention policy.
Our handling of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.
These Terms are governed by the laws of Queensland, Australia. Any dispute is submitted to the non-exclusive jurisdiction of the courts of Queensland.
We may update these Terms from time to time. We will post the revised version here with an updated date. Continued use of the service after changes take effect constitutes acceptance of the revised Terms.
